Terms & Conditions: Services

The following terms and conditions apply to all services offered by Vikki Patis Creative (VPC). By using these services, you accept these terms and conditions in full.

Pricing

Discounts are provided at VPC’s discretion and may be withdrawn at any time.


Hosting and other payments

VPC does not provide nor organise third-party hosting. Hosting is provided via the platform on which a website is designed, or via the third party hosting company arranged by the client. VPC does not set up any accounts on behalf of the client or arrange any recurring payments such as fees for domains, plans, etc. The client must maintain these separately. The loss, cancellation, or otherwise of the domain/plan/account brought about by non or late payment is not the responsibility of VPC.


Turnaround time

Prior to a project commencing, an estimated turnaround time will be provided. Please note that these may differ and/or be extended due to the amount of work required on each project as it progresses, VPC’s availability, or extenuating circumstances. The client will be kept up to date at all times.


Content

The client must provide all of the content and copy required for their website prior to the project commencing. The client will be notified of any gaps in good time, however VPC is not responsible for filling those gaps, unless content creation has been agreed upon. Content creation is charged at an additional rate of £85 per hour, with a minimum charge of half an hour.


Client review

Once work has been completed on a project, the client has the opportunity to review and request changes prior to completion and handover. The client has seven (7) calendar days to request additional changes after being notified, unless otherwise agreed. Should these requests constitute major changes or require more than one (1) hour of work, or fall outside of the review period, an hourly rate of £85 will apply, with a minimum charge of half an hour.

For editorial clients, one (1) round of revisions will be undertaken, if required, based on client feedback for no extra charge. Timelines will be agreed upon between VPC and the client. No formatting will be undertaken unless paid for separately.

After the review period has passed and any requested changes have been made, the project will be handed over to the client and all data, including passwords, shall be deleted by VPC.


Liability

The client indemnifies VPC against all damages, losses, and expenses arising as a result of any and all actions or claims resulting from the client’s use of these services. VPC is not responsible for any content uploaded to a client’s website, including but not limited to the website’s privacy or other policies. Any errors or issues must be raised during the client review period or as soon as practicable. Any policies created or uploaded by VPC are not guaranteed to be compliant and VPC accepts no liability should an issue arise at any point in time.

Nothing in these terms shall operate to exclude or limit either party’s liability for: (a) death or personal injury caused by its negligence; (b) fraud; or (c) any other liability which cannot be excluded or limited under applicable law.

VPC shall not be liable under or in connection with these terms or any collateral contract for any: (a) loss of revenue; (b) loss of actual or anticipated profits; (c) loss of contracts; (d) loss of business; (e) loss of opportunity; (f) loss of goodwill or reputation; (g) loss of, damage to or corruption of data; (h) any indirect or consequential loss; (i) loss or damage caused by any inaccuracy, omission, delay or error, whether as a result of negligence or other cause in the production of the website; or (j) loss or damage to the client’s artwork/photos supplied for the website, whether as a result of negligence or otherwise.

The entire liability of VPC to the client in respect of any claim whatsoever or breach of this agreement, whether or not arising out of negligence, shall be limited to the charges paid for the services under this agreement in respect of which the breach has arisen.


Data protection

VPC shall only keep client information for as long as it takes for a project to be completed, or for as long as necessary for VPC to fulfil legal or regulatory obligations. For websites, no data shall be stored anywhere outside of client communications, and for editorial/mentoring/consultancy projects, documents shall be worked on in programs such as Word, Google Docs, or Libre Office. All information and documentation, plus any backups, including cloud storage, shall be deleted upon completion of a project. No data will be shared with a third party unless there is a legal or regulatory requirement to do so.

Upon completion of a website, it is recommended that the client changes the password, however no login details will be stored by VPC after handover. Should the client wish to engage VPC for future work, e.g. website updates, the login information will need to be shared each time, as it will be deleted after each project is complete.

The exception to this is where clients prefer to appoint and keep VPC as an administrator on their site. In such cases, written confirmation is required, and consent can be revoked at any time by removing VPC via the Users tab on the dashboard or by emailing VPC. VPC warrants that no work will be undertaken without prior approval and that client data remains secure.

VPC does not require design credit to be listed on websites, however a client may add it at their discretion. The client agrees that all websites designed by VPC may be used for marketing purposes.


Termination

Either party may terminate the agreement via email at any time. The client will be invoiced for any work completed prior to termination, with payment due within fourteen (14) calendar days.
